1. OWNERSHIP
The European Olympic Committee (“EOC”), is an international non-governmental not-for-profit organisation, with registered office in Via della Pallacanestro, 19, Palazzina CONI - "Villino Giulio Onesti" - 00135 Rome – Italy, Tel.(+39) 06 36 85 78 28, Fax (+39) 06 36 85 76 66, is the sole owner of the web page www.european-games.org (hereinafter, the “the EOC Digital Ecosystem”) and the host of the Contest run through it.
2. TERMS OF USE OF THE EOC DIGITAL ECOSYSTEM
2.1. Lawfulness of the use
The User commits to use the EOC Digital Ecosystem in accordance with the Law, the present Terms and Conditions, and other notices, usage regulations and instructions presented to him/her, as well as with the goodwill and morality commonly accepted and of public order.
2.2. EOC Content
In these Terms and Conditions, “EOC Content” refers to any audio, visual or other content, information, or materials accessible through the EOC Digital Ecosystem such as texts, illustrations, artworks, graphics, data, moving and still images, sounds, music, or software. The EOC Content is protected by copyright, trademarks, or other proprietary rights and laws. All rights, including all intellectual property rights, or other proprietary rights in the Services, EOC Content, except for the User Content (as defined below), are owned by the EOC, or licensed to it by the respective rights owners. All rights not expressly granted to you under the present Terms and Conditions are reserved.
2.3. User Content
Through the EOC Digital Ecosystem, the User may be offered the possibility to provide feedback and interact with other Users, by making comments or by making available other types of content (“User Content”).
The User retain all ownership rights and are solely responsible for the User Content. The User grants the EOC a non-exclusive, royalty-free, worldwide, transferable license (with a right to sublicense) to use, reproduce, display, distribute, make available and prepare derivative works of the User Content, in whole or in part, in any media formats and through any media now known or to be known, in connection with the EOC. The User also grants each other User of the EOC Digital Ecosystem a non-exclusive, royalty-free, worldwide license to access the User Content through the EOC Digital Ecosystem and to use it in accordance with the present Terms and Conditions. All licenses granted to us and the Users of the EOC Digital Ecosystem in relation to the User Content shall continue indefinitely, unless the User requests the EOC to remove the User Content.
2.4. Users of the EOC Digital Ecosystem
The EOC Digital Ecosystem is intended for Users who are 16 years old (or older) and who are either of legal age under the laws of their country of residence or who have obtained the consent of a parent or guardian to use the EOC Digital Ecosystem.
The EOC Digital Ecosystem is at User’s own risk and the User is responsible for ensuring that his/her use of the EOC Digital Ecosystem complies with applicable laws of your country of residence or use.
The EOC reserves the right to terminate access to the EOC Digital Ecosystem at its own discretion, in particular if it believes that the User do not comply with these Terms and Conditions.
2.5. How to use the EOC Digital Ecosystem
The EOC grants the User a limited, revocable, non-exclusive, non-transferable and non-sub licensable, license to access and use the EOC Digital Ecosystem and EOC Content included in it, provided that the User complies with the Terms and Conditions and in particular the following conditions:
- The EOC Digital Ecosystem cannot be used for advertising purposes, or in any manner implying an association between a third party, or a third party’s product and services, and the EOC without our prior written authorization;
- Through available functionalities, the User is authorized to share EOC Content for personal and non-commercial purposes only and in a manner otherwise consistent with these Terms and Conditions;
- The User may not upload or post on the EOC Digital Ecosystem any comment or other content that is unlawful, defamatory, violent, obscene, racist, discriminatory against any third party or otherwise contrary to the Olympic values;
- The User may not use, or attempt to use, the EOC Digital Ecosystem or the EOC Content to commit any unlawful act or to defame, harass, insult or impersonate other users or third parties;
- Except as expressly provided in these Terms and Conditions, The User is not authorized to copy, archive, download, reproduce, modify, broadcast, communicate to the public and/or make available, the EOC Digital Ecosystem or any EOC Content, without our prior written authorization;
- The User may not transfer, assign or sublicense any rights and licenses granted under the Terms and Conditions, but the EOC’s rights and obligations may be assigned by us without restriction;
- The User may not alter or modify or circumvent any component of the EOC Digital Ecosystem, or attempt to do so, or encourage or assist any other person to do so;
- The User may not launch any automated system, including without limitation, “robots,” “spiders,” or “offline readers,” “virus”, “worms”, “Trojan horse”, or any other logical device or sequence of characters that cause or are susceptible of causing any type of alteration in the EOC Digital Ecosystem, the informatic systems of the EOC or of third-parties;
- The User may not collect or use any personal information about other Users or third parties from the EOC Digital Ecosystem, nor use the EOC Digital Ecosystem for any commercial solicitation purposes;
- The User may not facilitate or encourage any violation of these Terms and Conditions by third parties.
3. THE PRE-SALE CAMPAIGN
3.1. Description
In order to promote its events, the EOC hosts a Ticketing Promotion “Pre-sale campaign” on the EOC Digital Ecosystem. The Pre-Sale Campaign is run in the form of an online landing page for registration to get the personalized code. This code will grant to the registered User a 25% discount on the purchase of up to 4 tickets to attend sports events during the European Games 2023. VIP tickets, opening/closing ceremonies tickets, other special events and already discounted tickets for whatsoever reason (e.g. minors, elders, other promotions, etc.), shipping costs and extra costs of collector tickets are excluded from the Pre-Sale Campaign.
3.2. Eligibility and subscription
The User mentioned at point 2.4. may participate to the Pre-sale Campaign by filling the online form available on the EOC Digital Ecosystem and by following the instructions therein, which are deemed to be considered part of these Terms and Conditions. By subscribing in such way, the User declares to accept these Terms and Conditions and the EOC’s Privacy Policy (which can be found here).
3.2. Duration
The online form will be accessible on the EOC Digital Ecosystem and registration will be possible from March 1st , 2023 and until the beginning of the official European Games 2023 ticketing sale. More specifically, the User accepts that the actual duration of the Pre-Sale Campaign depends on when the official tickets sale platform will be released online, which date is at the time of writing in course of definition and could possibly be further delayed.
3.4. Territorial scope
The Pre-Sale Campaign will be available worldwide. The legitimacy of the subscription and participation of the Users worldwide is nonetheless governed by the local laws of their respective countries, and the EOC will not be considered responsible for any infringement of such laws incurred by the Users.
3.5. Rules
In order to participate in the Pre-Sales Campaign, the User is required only to submit the form as explained at point 3.2. After having filled the online form, the User will receive a confirmation e-mail with the personalized code. The User who did not received such confirmation after the subscription may contact eocmedia@eurolympic.org. The personalized code may be used to purchase up to 4 tickets to European Games 2023 sport events. From that moment on, the User will officially have the possibility to apply the personalized code in order to purchase up to 4 tickets to the available European Games 2023 sports events. The User acknowledges and accepts that not all sport events tickets may be available at the same time during the Pre-Sale Campaign.
The Pre-Sale Campaign is aimed at the pre-sale of up to 10.000 tickets, i.e. 2.500 single users registrations. The Pre-Sale Campaign is therefore offered until this stock lasts.
4. RESPONSABILITY FRAMEWORK
4.1. Responsibility for the use of the EOC Digital Ecosystem
The User has full responsibility for any infraction that he/she can commit and of the damages caused by the usage of the EOC Digital Ecosystem, leaving the EOC exonerated of any kind of responsibilities that can derive from the actions of the User. The EOC will use all reasonable means and efforts to provide updated and reliable information in the EOC Digital Ecosystem. However, the EOC does not assume any commitment in relation to the absence of errors, or possible inaccuracy and/or omissions in any of the content accessible through the EOC Digital Ecosystem.
The User is the only responsible against any complaint or legal, judicial, or extrajudicial action, initiated by third persons against the EOC based on the use of the EOC Digital Ecosystem by the User. In this case, the User must assume as many costs, expenses and compensations occasioned to the EOC arising from such complaints or legal actions.
4.2. Responsibility of the functioning of the EOC Digital Ecosystem
The EOC excludes all accountability that can derive from interferences, omissions, interruptions, informatic viruses, telephonic issues or disconnections in the operational functioning of the electronic system unrelated to the EOC. Likewise, the EOC also excludes all accountability that can derive from delays or blocking of the operational functioning of the electronic system caused by deficiencies or overloads in the telephone lines or the Internet, as well as from damages caused by third parties through illegitimate intromissions outside the control of the EOC.
The EOC is entitled to suspend temporarily and without previous notice the access to the EOC Digital Ecosystem for reasons of maintenance operations, repairs, updates or improvements. In the case the EOC Digital Ecosystem contains any hyperlinks to other EOC Digital Ecosystems or websites not managed by the EOC, the EOC declares that it does not have any control over such places neither is responsible for the content included in these. The links that the EOC Digital Ecosystem could include will be offered only with informational purposes, without any evaluation of the content, owners, services or products offered in them. In any case, the EOC exonerates itself from any responsibilities in relation to the services provided by the mentioned third parties against all complaints of any nature and demands that can be related to them.
4.3. Limitation of responsibility of the EOC
Neither the EOC nor any other person or entity involved in creating, producing or delivering EOC Digital Ecosystem and the Contest will be liable for any incidental or consequential damages, including lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure, or for any damages for personal or bodily injury or emotional distress arising out of or in connection with these Terms and Conditions or from the use of or inability to use the EOC Digital Ecosystem or participate to the Contest, or from any communications, interactions or meetings with other Users of the EOC Digital Ecosystem, persons with whom you communicate or interact as a result of your use of the services whether based on warranty, contract, tort (including negligence), product liability or any other legal theory, and whether or not the EOC has been informed of the possibility of such damage, even if a limited remedy set forth herein is found to have failed of its essential purpose.
5. INTELLECTUAL PROPERTY RIGHTS
The EOC Digital Ecosystem and its content, including but not limited to the EOC Content, the graphic design, font and source codes, logos, texts, graphics, illustrations, photographs, and other elements that appear in the EOC Digital Ecosystem are the sole and exclusive property of the EOC. Likewise, all commercial names, brands or distinctive signs in the EOC Digital Ecosystem are protected by the Law. The EOC does not award any type of license or authorization of personal use to the User regarding its intellectual property rights or over any other right related to the EOC Digital Ecosystem and the services offered in it.
Consequently, the User acknowledges that the reproduction, distribution, commercialization, transformation, and in general, any other form of exploitation, by any procedure, of all or part of the content of the EOC Digital Ecosystem constitutes an infringement of the EOC’s intellectual property rights. The User, solely and exclusively, can use the material present in the EOC Digital Ecosystem for its personal and private use, being forbidden its use with commercial purposes or to incur in illicit activities.
6. CHANGES TO THE TERMS
The EOC can change these Terms and Conditions at any moment. When the Terms and Conditions are substituted or modified, they will be published in the EOC Digital Ecosystem and/or the user will be notified by e-mail. If the User continues using the EOC Digital Ecosystem, that will mean acceptance of the alterations introduced unless the User’s explicit acceptance or consent is required by the applicable law.
If the User does not agree with the modifications introduced, he/she can unsubscribe following the established procedure. It is recommended that the User periodically checks the Terms and Conditions, as they can be modified. The User can review the most updated version in the section “Terms and Conditions” on the landing page of the EOC Digital Ecosystem.
7. RIGHT TO MAKE MODIFICATIONS IN THE EOC DIGITAL ECOSYSTEM
The EOC reserves its right to carry out, without previous notice, the modifications in the EOC Digital Ecosystem that it considers appropriate.
The User accepts that the EOC can terminate, suspend or interrupt unilaterally, at any moment and without previous notice, the availability of the EOC Digital Ecosystem, without the possibility to demand any compensation by the User.
8. TERMS OF INTERNATIONAL USE
The EOC Digital Ecosystem regulated under the present Terms and Conditions is managed by the EOC, which is established in Italy. Although the EOC Digital Ecosystem can be accessed from outside of Italy due to the inherent nature of non-territoriality of Internet, the User accepts that the EOC Digital Ecosystem is meant to be used by any person or entity of any country or jurisdiction in which its use is not contrary to the local laws or regulations that apply at the time.
Consequently, if any or all of the elements in the EOC Digital Ecosystem are considered illegal in other countries, it is prohibited to access it, and its use by the User is exclusively under the User´s responsibility.
Likewise, the User is informed that it is possible that some the functionalities of the EOC Digital Ecosystem may not be available and/or function properly in every country due to technical and/or legal limitations.
9. APPLICABLE LAW AND JURISDICTION
The established relationships between the EOC and the User will be governed by the regulations in place regarding applicable legislation and competent jurisdiction. Nevertheless, for the cases where the regulations contemplate the possibility of the parts to select the applicable law and the location of the court, this Terms and Conditions are governed by the Italian law. The EOC and the User commit to submit any applicable controversies and/or litigation to the knowledge of the Courts of the city of Rome, Italy, with explicit renounce to any other alternatively competent court.

We use the personal information we collect to deliver and promote our services and events in conformity with the Terms and Conditions of the EOC Digital Ecosystem, to communicate with you and to perform promotional initiatives such as online contest, sweepstakes, games, etc.
PURPOSES OF THE PROCESSING
Main purposes and legal basis
- Registration and access to the EOC Digital Ecosystem: the personal data that you share in the registration process will be processed in order to facilitate your registration and access to the EOC Digital Ecosystem. Specifically, we will use the following personal data for these purposes:
- Email address (required): necessary for registration and access to the EOC Digital Ecosystem.
- Username (required): used to identify the user inside the EOC Digital Ecosystem.
- Country: used to display the EOC Digital Ecosystem sponsors correspondent to the selected country (the sponsors of the EOC Digital Ecosystem can vary depending on the country) and to identify the content to be displayed in the EOC Digital Ecosystem (some content can be geo-blocked due to exclusivity agreements with broadcasters in some countries).
- Identification data: name, last names, contact information, postal address.
- Personal data: age, date and place of birth, social and demographic information, as well as tastes and preferences.
- Social media profile data.
The legal basis for the aforementioned purposes is that the data processing is necessary for the execution of a contract in which the interested is one of the parties under the provisions of Art. 6.1 b) of Regulation (EU) 2016/679 (GDPR). -
Ticketing services and Sale and Pre-Sale Campaigns: the personal data that you share in the registration process will be processed in order to provide the demanded ticketing services in the context of Sale and/or Pre-Sale Campaigns run through the EOC Digital Ecosystem. Specifically, we will use the following personal data for these purposes:
- Email address (required): necessary for registration and access to the EOC Digital Ecosystem.
- Username (required): used to identify the user inside the EOC Digital Ecosystem.
- Country: used to display the EOC Digital Ecosystem sponsors correspondent to the selected country (the sponsors of the EOC Digital Ecosystem can vary depending on the country) and to identify the content to be displayed in the EOC Digital Ecosystem (some content can be geo-blocked due to exclusivity agreements with broadcasters in some countries).

Participation in the contests promoted through the EOC Digital Ecosystem: We inform you that the personal data you provide in the registration form or in specific forms associated to a specific contest will be processed for the purposes of facilitating, managing, maintaining and controlling your participation in the contest.
The legal basis for the processing of your data for the aforementioned purpose is the consent you have given us to process your data for the specific purposes selected pursuant to the provisions of art. 6.1 a) of Regulation (EU) 2016/679 (GDPR). Your personal data will be kept for this purpose until you revoke the consent given. -
In-app notifications related to the EOC Digital Ecosystem: In the event that you access the EOC Digital Ecosystem's mobile application, you may receive in-app notifications related to the EOC Digital Ecosystem (for example, about changes in the privacy policy, legal notice or terms and conditions, announcements about new functionalities, etc.). You can oppose to the reception of such communications at any time, through the corresponding section on the EOC Digital Ecosystem. These notifications are displayed only when you are within the mobile application and the supplier will use your user ID to send you the notification.
The legal basis for the aforementioned purposes is that the data processing is necessary for the execution of a contract in which the interested is one of the parties under the provisions of Art. 6.1 b) of Regulation (EU) 2016/679 (GDPR). -
Internal reports: We will process in aggregate form the personal data you have provided through the registration or social login, data on your usage of the EOC Digital Ecosystem (user ID, device ID, device model, operating system and telemetry, for example, clicking on a particular content or the time you stay in the EOC Digital Ecosystem environment) and finally, interactions with communications of any kind that you receive (e.g., clicking on the content of a communication) or in the communication with the EOC Digital Ecosystem support, for the development of relevant metrics and statistics that allow us to analyse the use made of the EOC Digital Ecosystem by the different user segments generated and the impact of the campaigns, assessing the interest that the campaigns have aroused among the aforementioned segments based on the data analysed. Data stored and processed under this purpose will be retained as anonymised data.
The legal basis for the aforementioned purpose is that the processing is necessary for the satisfaction of a legitimate interest under the provisions of art. 6.1 f) of Regulation (EU) 2016/679 (GDPR) consisting of the analysis of the users’ usage of the EOC Digital Ecosystem and the impact of its campaigns to improve the services offered to users.
Use of the advertiser identifier ("IDFA") on iOS devices (Apple)
The use of IDFA for the purpose of "Internal Reporting" requires the user's tracking permission within Apple's iOS operating system. In case the user has not given permission for the use of IDFA, SPE will be able to carry out such purpose using the device's IDFV.
The user can, at any time, accept or reject the tracking permission in the iOS settings of the user's Apple device.
The legal basis for the aforementioned purpose is that the processing is necessary for the satisfaction of SPE's legitimate interest under the provisions of art. 6.1 f) of the General Data Protection Regulation as well as Spanish Organic Law 3/18 of December 5 on the Protection of Personal Data and Guarantee of Digital Rights, and Regulation (EU) 2016/679 consisting of extracting learnings from the information provided and obtained from users that allows it to improve the EOC Digital Ecosystem and optimize the communication campaigns it carries out based on the interest that these generate among the different groupings of users.
- Push notifications about the content of the EOC Digital Ecosystem: In the event that you access the EOC Digital Ecosystem's mobile application, you may receive push notifications regarding the content of the EOC Digital Ecosystem through the usual notification system of your Smartphone or Tablet (e.g. alerts about new programs, reminders of competitions and sports fixtures, etc.). You can oppose to the sending of such communications, at any time, through the corresponding section of the EOC Digital Ecosystem or through the settings of your own Smartphone or Tablet.
The legal basis for the processing of your data for the aforementioned purpose is the consent you have given us to process your data for the specific purposes selected pursuant to the provisions of art. 6.1 a) of Regulation (EU) 2016/679 (GDPR). Your personal data will be kept for this purpose until you revoke the consent given.

EOC commercial communications: In order to send you commercial communications via email, push notifications, in-app or SMS or other instant messaging channels about its activities, (the competitions it organizes, campaigns, public viewings, shows or live events), products, services, contests, offers, sweepstakes and/or promotions, or contests, offers, sweepstakes and/or promotions carried out by us on products and services promoted jointly with our official sponsors, national or international federations and national and international television channels or media, among other collaborators, with the scope of promoting the European Games ("EG") and the European Youth Olympic Festival ("EYOF") upcoming editions.
The legal basis for the processing of your data for the aforementioned purpose is the consent you have given us to process your data for the specific purposes selected pursuant to the provisions of art. 6.1 a) of Regulation (EU) 2016/679 (GDPR). Your personal data will be kept for this purpose until you revoke the consent given.

Simple profiling: To enable us to send you targeted communications via email, SMS or other instant messaging channels about our services and events, sponsors or partners (for example, we may send you communications about services and events that may be of interest to you based on the age or province of residence you have provided in your profile).
The aforementioned information will be directed to simple segments (groupings of users that are made based on the information provided by them in their profile) that we can elaborate taking into account the following:
- Low level of profile detail, by creating simple segments such as, for example, segments on women over 25 years of age.
- Barely thorough profile. To make the segments, we will only process the personal data that you have provided in this EOC Digital Ecosystem.
- Positive consequences for the user. We may send you commercial communications that best fit the profile you have declared, avoiding unwanted commercial communications or uninteresting content.
The legal basis for the processing of your data for the aforementioned purpose is the consent you have given us to process your data for the specific purposes selected pursuant to the provisions of art. 6.1 a) of Regulation (EU) 2016/679 (GDPR). Your personal data will be kept for this purpose until you revoke the consent given.

Thorough profiling: we will develop a thorough profile of you so that it can offer you personalized experiences, information and products by sending you personalized commercial communications via email, SMS or other instant messaging channels, send you personalized push or in-app notifications (provided that you have granted consent for this purpose) or show you banners with personalized advertising on websites, apps or social networks about our services and events or its sponsors or partners.
Thus, the aforementioned information will be directed to the segments (groupings of users that are made based on the information obtained from them or the use made of the EOC Digital Ecosystem that we can develop based on the following data sources:
- The information you provide us during registration;
- The information obtained through social login;
The legal basis for the processing of your data for the aforementioned purpose is the consent you have given us to process your data for the specific purposes selected pursuant to the provisions of art. 6.1 a) of Regulation (EU) 2016/679 (GDPR). Your personal data will be kept for this purpose until you revoke the consent given.
FOR HOW LONG DO WE KEEP YOUR PERSONAL DATA?
The personal data we process will be kept as long as the purposes for which they were collected persist and/or you do not revoke the consent you have given, or you do not exercise your rights of deletion, opposition or limitation of processing.
In this sense, we will keep your personal data duly blocked for the following retention periods for the sole purpose of meeting the responsibilities of any kind that may arise:
- Registration and access to the EOC Digital Ecosystem: the data provided for registration and access to the EOC Digital Ecosystem will be retained as long as you are registered on it, this purpose persists and, once it is finished, during the period of limitation of legal actions that may arise from it.
- Ticketing services and Sale and Pre-Sale Campaigns: the data provided for purchasing tickets will be retained for the time required to perform the sale, as long as this purpose persists and, once it is finished, during the period of limitation of legal actions that may arise from it.

YOUR RIGHTS
